PROVE IT — couple check-ins

These Terms are an agreement between you and Gergő Miklós, an independent developer based in Hungary, for your use of PROVE IT. By downloading, accessing, or using the app, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.
Apple’s standard EULA
PROVE IT is licensed, not sold, under Apple’s Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. That EULA applies in addition to these Terms. If they conflict, mandatory law and Apple’s applicable terms control. Apple has no obligation to provide support for PROVE IT and is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries and may enforce the applicable EULA against you.
Adults only
You must be at least 18 years old and legally capable of entering this agreement to use PROVE IT. The app is not intended for minors.
Consent is required — coercion is prohibited
PROVE IT may be used only between two adults who knowingly and freely choose to pair. You must not pair someone else’s device without permission, pressure someone to install, pair, stay paired, enable Route History, or provide proof, or use PROVE IT to coerce, harass, threaten, stalk, control, or secretly monitor anyone.
A partner can ask for proof but cannot remotely activate the other person’s camera, microphone, screen recording, battery, or location. The recipient performs each capture visibly on their own device and may decline or ignore a request. Ignoring a request may be recorded as missed after its deadline, but it never authorizes hidden capture. An agreed Night Watch can schedule requests automatically; it cannot capture or send responses automatically. Either person can unpair at any time.
Route History and sensitive content
Route History is optional. When enabled with the necessary iOS permission, it can continuously keep a rolling 75-minute location trail on-device, including while the app is in the background if “Always” access was granted. It is uploaded only when the user deliberately submits it in response to a Route request. You are responsible for deciding whether to enable it and what to send.
Proof can expose private conversations, other people, homes, workplaces, health, beliefs, sexuality, finances, or other sensitive information. Do not capture or send content unless you have the right and all necessary consent to do so. Respect the privacy, image, recording, employment, and communications laws that apply where you are.
Your content and the licence you give us
You retain your rights in photos, videos, screen recordings, audio, notes, receipts, and location you submit. You grant us a limited, non-exclusive, worldwide licence to host, copy, process, transmit, display, and delete that content only as needed to run, secure, and support PROVE IT, deliver it to your paired partner, and comply with law. This licence ends when the content is deleted from the service, except for limited copies that must be retained by law or in security backups/logs for their normal lifecycle.
You represent that you have the rights and permissions needed for everything you submit. Do not submit unlawful, abusive, infringing, exploitative, or non-consensual content.
Receipts, downloads, and exports
Each paired phone can retain receipt records and local proof independently of the server’s 30-day retention. Users can also save, screenshot, copy, or share receipts and proof through iOS or another service. Once content is exported from PROVE IT, the recipient, destination service, and device owner control their copies; we cannot retrieve or delete them. Do not export another person’s content without permission, and understand that unpairing or account deletion cannot erase copies someone already saved or shared outside the service.
Annual subscription and free trial
PROVE IT offers an auto-renewable annual subscription through Apple’s App Store. The localized price, subscription period, and any introductory offer available to your Apple Account are shown in the app and Apple’s purchase sheet before you confirm. If Apple says you are eligible for the advertised free trial, access begins when you confirm and Apple charges the displayed annual price when the trial ends unless you cancel first. If you are not eligible for a trial, Apple charges at purchase confirmation.
The subscription renews automatically each year at the displayed renewal price unless you turn off auto-renew at least 24 hours before the current period ends. Apple may charge your Apple Account within 24 hours before renewal. Manage or cancel in Apple ID settings under Subscriptions. Apple handles billing, price-change notices, refunds, and billing disputes under its policies. Restore Purchase in the app can re-check an existing entitlement.
Deleting your PROVE IT account, unpairing, or deleting the app does not cancel an App Store subscription. You must cancel it separately through Apple to stop future renewal charges. Statutory consumer rights are not limited by these Terms.
Anonymous account, unpairing, and deletion
PROVE IT creates an anonymous server device identity even though it does not require email or password sign-in. Deleting the app alone may leave that identity in the iOS Keychain and on the server. Use Delete my account in the app to end any pair, remove the device profile from our server, and clear the app’s local history after server deletion succeeds.
Unpairing ends the pair for both people and removes shared server check-ins, plans, events, and proof media from the active service. Residual database content is scheduled for deletion from disaster-recovery backups when it reaches 30 days; an interrupted rotation is retried on the next successful run. Unpairing removes cached proof media from the phones but can leave receipt records locally until each person deletes their own history. Account deletion and unpairing cannot remove a partner’s screenshots, exports, or other copies made outside the service.
Acceptable use
- Do not use PROVE IT for illegal, deceptive, abusive, or harassing conduct.
- Do not access or attempt to access another pair’s data, guess or automate pairing codes, bypass consent or payment controls, or interfere with the service.
- Do not upload malware or content that violates privacy, intellectual-property, publicity, image, recording, or other rights.
- Do not reverse engineer, resell, rent, or redistribute the app except where applicable law or Apple’s EULA permits it.
- Do not present a missed, declined, partial, or edited/exported receipt as something it is not.
Privacy
Our Privacy Policy explains data collection, optional background Route History, server and local retention, service providers, international transfers, and your rights. You must use PROVE IT in a way that respects your partner’s and third parties’ privacy.
Availability and safety
PROVE IT is not an emergency, safety, parental-control, or location-monitoring service. Do not rely on it where someone’s safety, liberty, employment, or legal rights depend on a request or notification arriving. Pushes, captures, uploads, clocks, maps, and sync can be delayed, unavailable, inaccurate, interrupted, or lost. Approximate location and device settings can affect results. We may change, suspend, or discontinue features to maintain, secure, or improve the service.
Intellectual property
Except for user content, PROVE IT’s software, design, branding, and service are owned by or licensed to the developer. These Terms grant only the personal, revocable, non-transferable right to use the app under Apple’s EULA; they do not transfer ownership of the service or brand.
Suspension and termination
You may stop using the service, unpair, or delete your account at any time, subject to the separate subscription-cancellation rule above. We may restrict or terminate access where reasonably necessary to investigate abuse, protect people or the service, comply with law, or address a serious or repeated breach of these Terms. Where practical and lawful, we will provide notice.
Disclaimers and liability
To the extent permitted by law, PROVE IT is provided “as is” and “as available” without warranties that it will always be uninterrupted, accurate, secure, or suitable for a particular relationship or dispute. We are not liable for indirect, incidental, special, or consequential loss caused by use of the app or by another user’s conduct. Where liability cannot lawfully be excluded, these limits apply only to the maximum extent permitted. Nothing here excludes liability or consumer rights that cannot be excluded under applicable law.
Governing law and disputes
These Terms are governed by Hungarian law, without depriving consumers in the European Economic Area or elsewhere of mandatory protections or courts available in their country of residence. Please contact us first so we can try to resolve a dispute informally. You may also use any consumer-protection or dispute-resolution route available under mandatory law.
Changes
We may update these Terms when the app, providers, or law changes. We will update the date above and provide appropriate notice for material changes. If you do not agree to revised Terms, stop using the app and delete your account; remember to cancel any App Store subscription separately.
